These Terms of Service ("Terms") govern your access to and use of Smith Agent Factory (the "Platform," "we," "us"). By creating an account or using the Platform you agree to these Terms. If you do not agree, do not use the Platform.
You are responsible for your account, credentials, and all activity under it. You must provide accurate information and are responsible for keeping your password secure. You must be at least 18 and able to form a binding contract.
Paid plans are billed per the plan you select. The "free while you process" Merchant Account benefit applies only while you remain an active processing merchant in good standing; if processing stops or drops below the qualifying volume, your plan reverts to its standard price. All estimates (savings, residuals, ROI, forecasts) are estimates, not guarantees or quotes.
You will not use the Platform to break the law, infringe others' rights, send spam, scrape without permission, bypass paywalls/consent/robots rules, or generate content that is unlawful, harmful, or deceptive. Outbound communications must comply with CAN-SPAM, TCPA, and platform rules. You are responsible for content you create, publish, host, or send.
The Platform uses AI to generate suggestions, drafts, plans, and analyses. Outputs may be inaccurate or incomplete — you must review them before relying on or acting on them. Governed actions are staged for human approval; nothing sends, deploys, moves money, boards a merchant, or files anything on its own without your authorization. AI outputs do not constitute legal, financial, tax, or professional advice.
Payment processing, when enabled, is provided by third-party processors (e.g., Tilled, Stripe) and is subject to their terms and underwriting. We are not a bank, processor, or acquirer. Third-party integrations you connect are governed by their own terms; you are responsible for your use of them.
Your data is scoped to your tenant and handled per our Privacy Policy. You retain ownership of your content. You grant us a limited license to process it solely to provide the Platform.
Participation in the affiliate program is subject to the program terms shown in the Affiliates section, including self-referral prohibitions, valid attribution, and payout minimums. We may withhold or reverse commissions for fraud, chargebacks, or refunds.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.
You may stop using the Platform at any time. We may suspend or terminate accounts that violate these Terms. We may update these Terms; continued use after changes constitutes acceptance.

We collect the information you provide (account details, content you create) and basic usage data to operate the Platform. Your data is isolated to your tenant. We use third-party processors and AI providers only to deliver the service.
We do not sell your personal data. We use it to provide, secure, and improve the Platform, and to communicate with you. You can access, export, correct, or delete your data (see the DataComply tools and your account settings), subject to legal retention requirements.
